Acceptable Use Policy

This Acceptable Use Policy (AUP) supplements the Terms of Service. By using KenyaSMS you agree to comply with both.

1. Prohibited Content

You must not use KenyaSMS to send messages that:

  • Are unsolicited (spam) or sent to recipients who have not opted in.
  • Promote phishing, fraud, scams, fake jobs, fake deliveries, or impersonate another brand or person.
  • Contain hate speech, threats, harassment, or content that incites violence.
  • Promote illegal goods or services under Kenyan law (including unlicensed gambling, narcotics, and counterfeit goods).
  • Contain sexually explicit content.
  • Violate intellectual-property rights of any third party.

2. Regulatory Compliance (CAK)

You must comply with the Communications Authority of Kenya (CAK) Bulk Messaging Guidelines, including:

  • Opt-out: Promotional messages must include a clear opt-out instruction (e.g., the auto-appended STOP suffix).
  • Quiet hours: Promotional messages must not be sent between 8:00 PM and 8:00 AM East Africa Time. KenyaSMS enforces this automatically for promotional message types.
  • Sender ID truthfulness: Sender IDs must accurately identify your organisation. Brand impersonation is grounds for immediate termination and forfeiture of registration fees.

3. Sender ID Misuse

Each Sender ID is registered to a specific organisation. Lending, sharing, or sub-licensing a Sender ID to a third party without written authorisation from KenyaSMS and the upstream operator is prohibited.

4. Volume and Rate Limits

Account-level rate limits exist to protect upstream networks. Bypassing or attempting to bypass these limits — including by spreading the same campaign across multiple sub-accounts — is a violation of this AUP.

5. API Abuse

Automated retries on permanent errors, credential sharing, and reverse-engineering the platform for the purpose of disrupting service are prohibited.

6. Enforcement

Violations may result in any combination of: warning, throttling, account suspension, account termination, forfeiture of wallet credit, and reporting to CAK or law enforcement. We reserve the right to act without prior notice when a violation poses an immediate risk to the network, recipients, or other customers.

7. Reporting Abuse

To report a suspected violation by another sender, email webzillacreators@gmail.com with as much detail as possible (sender ID, recipient phone, message body, timestamp).

8. Updates

We may update this AUP as regulations evolve. Material updates are notified via your registered email.
