1. Acceptance of Terms
By accessing or using KenyaSMS services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Service Description
KenyaSMS provides bulk SMS messaging services for businesses operating in Kenya. Our services include SMS sending via web dashboard and API, campaign management, contact management, and related features.
3. Account Registration
You must provide accurate information during registration. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activities under your account.
4. Acceptable Use
You agree not to use our services to:
- Send spam or unsolicited messages
- Send messages that violate Kenyan law or Communications Authority regulations
- Send threatening, harassing, or fraudulent content
- Impersonate other individuals or organizations
- Send messages outside permitted quiet hours (8PM-8AM for promotional)
5. Pricing & Payments
SMS pricing is prepaid. You must maintain a positive wallet balance to send messages. Prices are in Kenyan Shillings (KES) and may vary by network. We reserve the right to adjust pricing with prior notice.
6. Regulatory Compliance
You must comply with the Communications Authority of Kenya regulations, including opt-out requirements for promotional messages and quiet hours enforcement. KenyaSMS automatically handles opt-out suffixes and quiet hours as required by law.
7. Service Level
We strive for high delivery rates but do not guarantee 100% message delivery, as delivery depends on network operators and recipient devices. SLA guarantees are available for Diamond tier accounts.
8. Data Protection
We handle your data in accordance with Kenyan data protection laws. See our Privacy Policy for details.
9. Limitation of Liability
KenyaSMS shall not be liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability shall not exceed the amount paid by you in the preceding 12 months.
10. Governing Law
These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
